Terms of Service

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding contract to use the Services. The Services are intended for business use only, by individuals and entities operating or seeking to operate a freight dispatch, brokerage, or carrier business. DOT Lead List is a business-to-business (B2B) service and is not intended for personal, household, or consumer use. By using the Services, you represent that you are using them in connection with a business purpose.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

DOT Lead List provides a subscription-based lead platform and software tools for freight dispatchers, brokers, and carriers, which may include:

• A customer relationship management (CRM) tool with automated daily motor carrier lead delivery;
• Lead management tools, including storage of carrier information and outreach records;
• Visual Kanban outreach pipeline and follow-up calendar tools;
• Lead export features to CSV and spreadsheet formats; and
• Related software features and resources.

We may add, modify, or discontinue features of the Services at any time.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current information when creating an account and to update it as needed. Notify us immediately at support@dotleadlist.com if you suspect unauthorized use of your account.

4. Subscription, Billing, and Cancellation

• Billing. The Services are offered on a recurring subscription basis. Your subscription will automatically renew at the end of each billing cycle unless canceled.
• Payment Processing. All payments are processed through Stripe. By subscribing, you authorize DOT Lead List (via Stripe) to charge your designated payment method on a recurring basis until you cancel.
• Cancellation. You may cancel your subscription at any time through your account settings or by contacting support@dotleadlist.com. Cancellation will take effect at the end of your then-current billing period.
• No Refunds. All payments are non-refundable. You will continue to have access to the Services through the end of the billing period in which you cancel, but no prorated or partial refunds will be issued.
• Price Changes. We may change subscription pricing at any time. We will provide advance notice of price changes, which will take effect at your next billing cycle.

5. Your Data and Content

5.1 Data You Submit

As part of using the Services, you may input, upload, or store information about your business, outreach notes, and contacts ("Customer Data"). You are solely responsible for the accuracy, legality, and appropriateness of any Customer Data you submit.

5.2 Your Legal Responsibilities

You represent and warrant that you have all necessary rights and consents to collect, store, and process any information you submit to the Services, and that your use of the Services complies with all applicable laws, including data privacy and telemarketing laws. DOT Lead List does not request or require Social Security Numbers; you are responsible for safeguarding and lawfully handling any data you enter.

5.3 License to Us

You retain ownership of your Customer Data. You grant DOT Lead List a limited, non-exclusive license to host, store, process, and display your Customer Data solely as necessary to provide and improve the Services.

6. Third-Party Services

The Services rely on and integrate with third-party providers, including but not limited to Stripe (payment processing) and cloud database providers. Your use of these integrated features may also be subject to the applicable third party's own terms of service. We are not responsible for the acts, omissions, or downtime of third-party providers.

7. Disclaimers & No Guarantee of Results

• DOT Lead List provides lead data resources and software tools. We do not guarantee any specific financial success, contract closures, conversion rates, or business results. Building a successful logistics or dispatching business requires active outreach and execution.
• Lead data is compiled from official government databases and industry registries. While we strive for accuracy, DOT Lead List makes no warranty that lead contact records are free of errors or changes made by carriers after publication.

8. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose, including spamming, harassment, or violation of carrier or consumer protection laws;
• Attempt to reverse-engineer, copy, or resell the Software or its underlying code;
• Interfere with or disrupt the integrity or performance of the Services;
• Use automated means to scrape or extract data from the Services beyond normal intended use;
• Upload malicious code or attempt to gain unauthorized access to other users' accounts or data; or
• Misrepresent your identity or affiliation with any carrier, broker, or business.

We reserve the right to suspend or terminate accounts that violate this section.

9. Intellectual Property

The Services, including all software, templates, trademarks, and content provided by DOT Lead List, are owned by DOT Lead List or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for violation of these Terms, non-payment, or any conduct we believe is harmful to DOT Lead List, other users, or third parties. Upon termination, your right to use the Services will immediately cease.

You agree to indemnify and hold harmless DOT Lead List, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your Customer Data; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

14. Dispute Resolution; Binding Arbitration

• Agreement to Arbitrate. You and DOT Lead List agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding arbitration, rather than in court, except that either party may bring an individual action in small claims court.
• Class Action Waiver. You and DOT Lead List agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
• Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@dotleadlist.com within 30 days of first accepting these Terms.

15. Modifications to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as by email or an in-app notification). Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DOT Lead List regarding the Services.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
• No Waiver. Our failure to enforce any right or provision will not be considered a waiver of that right.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
